1. Tour guide services are arranged for you by Hamburg Travel GmbH. By carrying out this activity, Hamburg Travel GmbH does not supply its own services but instead arranges them on behalf and for the account of the tour guide in question. The contract for the service booked is therefore concluded exclusively between the customer and the tour guide. Hamburg Travel GmbH and the customer are linked only by an agency agreement.

2. The tour guide shall be booked through Hamburg Travel GmbH. You will receive a confirmation of this booking from Hamburg Travel GmbH. The price indicated on the booking confirmation for the guided tour shall be paid to Hamburg Travel GmbH.

3. You can cancel the contract for the guided tour concluded with the tour guide at any time by notifying Hamburg Travel GmbH. Your cancellation should quote your booking reference. The relevant date is the date on which the notice of cancellation is received by Hamburg Travel GmbH. We advise that you give written notice of cancellation. The tour guide may claim compensation at a flat rate based on the following percentages of the price agreed for the guided tour:
8 or more days before the guided tour 0%
between 7 days and 1 day before the guided tour 80%
on the day of the guided tour 100%
In any case you are entitled to furnish evidence to prove that no loss was incurred as a result of your cancellation or that the actual loss incurred was significantly less than any flat-rate fee demanded from you. If this is the case, you are obliged to pay the lower costs (or nothing if no loss was incurred). The aforementioned flat-rate fees notwithstanding, the tour guide reserves the right to demand greater compensation for specific loss incurred. In this case, the tour guide is obliged to provide details and evidence of the specific amount of compensation demanded, taking account of the expenses saved and any alternative use of the service booked.

4. The times for meeting the tour guide agreed in the booking confirmation are binding. The tour guide is obliged to wait for one hour at the agreed meeting place in case you are late. Time spent waiting is subject to charge, i.e. the duration of the guided tour shall be reduced by the time spent waiting. The number of participants on guided tours is limited to 20 people per guide. If on the day – contrary to your booking – you wish for up to five more people to take part, 6,50 € per person must be paid directly to the tour guide before the guided tour. If you wish for more than 25 people to take part, an additional fee equivalent to the fee agreed for 20 people must also be paid directly to the tour guide before the guided tour.

5. Hamburg Travel GmbH acts solely as the agent of third-party services and is responsible exclusively for the proper arrangement of the guided tour and not for the proper performance of the guided tour. Hamburg Travel GmbH is not liable for non-performance or poor performance of the arranged contract. Hamburg Travel GmbH’s liability is restricted to intent and gross negligence. Liability in respect of ordinary negligence is excluded. The above exclusion of liability does not apply to death, physical injury or damage to health. Claims based on failure to provide services in accordance with the terms of the contract must be addressed to the tour guide in question without delay.
