Usage Terms and Conditions for photos in the photo archive of Hamburg Tourismus GmbH

1. All photos are protected by copyright law.

2. Hamburg Tourismus [Tourism] GmbH (HHT) permits the depiction, publication and reproduction of these photos in the press as well as in analogous publications exclusively for tourism-related advertising. In this regard, the photos may be used only for the presentation of travel destinations, tourist sites and tourist offerings of Hamburg.

3. Merely the type of use defined in Clause 2 requires no approval and is free of charge.

4. The use of the photos in digital media – also with regards to the type of use defined in Clause 2 – shall require HHT’s prior approval and thus such approval must be requested from HHT before any planned publication is made.

5. The use of photos in commercial publishing house products or other publications for resale purposes is not permitted insofar as the use of the photos does not correspond exclusively to the type of use defined in Clause 2.

6. If you wish to use the photos for your own commercial purposes or not for tourism-related advertising for Hamburg, you have the option of inquiring about the rights of use from the authors of the photos and, where applicable, acquiring them. Please contact us in this regard.

7. The depiction, publication or reproduction has been/is also permitted to other users.

8. The user himself may not assign the rights conveyed upon him to third parties. He may not disseminate the photos in any form (neither as reflection originals, print-outs, copies, files nor upon CDR) or offer them in online systems for use or distribution. Excepted from this is the dissemination to companies which have been commissioned by the user with the production of the depiction, publication or reproduction specified in Clause 2.

9. The user shall be obliged to make reference to the author of the photo or the owner of the usage rights (owner: Hamburg Tourismus GmbH).

10. Any fundamental change in the photo’s message by means of photo montages of any kind is not permitted without the approval of Hamburg Tourismus GmbH.

11. Immediately after production is completed, the user shall be obliged to send two master copies at its own expense to Hamburg Tourismus GmbH or inform it of the web site address if it is used on the Internet.

12. Hamburg Tourismus GmbH reserves the right to revoke the granting of the rights of use owing to an important reason. In this case, the user shall be obliged to make no further depictions, publications or reproductions. Finished products may – provided that they are considered to be appropriate in accordance with this agreement – be resold.

13. In the event of a violation of this agreement, Hamburg Tourismus GmbH may demand that the user remove all its products with the depiction of the photos at its own expense and either correct them or completely discontinue any such dissemination. Furthermore, in this case, Hamburg Tourismus GmbH reserves the right to assert damage compensation claims.

14. In the event that the photos are exploited for one’s own commercial purposes and which has not been agreed, Hamburg Tourismus GmbH or the photos’ author shall be entitled to fees which are customary for the market. Furthermore, Hamburg Tourismus GmbH and the photos’ authors reserve the right to assert damage compensation claims.

15. The files provided have been prepared to the best of one’s knowledge and belief. Nevertheless, neither the publisher nor the manufacturer assumes liability for errors in the documents as well as for resulting system errors.
